Davies Vs. Mann case relating to contributory negligence, the principle first applied by the Court came to be known as the ‘Last opportunity rule’. Last opportunity rule is a rule that makes the person who had the last opportunity to avoid an accident liable for it. At one time it was very important when a finding of contributory negligence meant that a party failed in his action but is less so now.
